1. These two actions, having been consolidated as one action on 24 January 2002, were tried by me together. For the sake of convenience, Mark Honour Limited - the Defendant in HCA 9627/2000 ("the 1st action") and the Plaintiff in HCA 1519/2001 ("the 2nd action") was referred to at the trial and will continue to be referred to in this judgment as "the Defendant" or simply "Mark Honour".
