CORRIGENDUM

Paragraph 48 on page 28 of the Judgment should read:

“	Accordingly, the Plaintiff's share is 40% of the total reinstatement costs of the private access road of 2,465m2, which is 986 m2, at $295,800.”

Paragraph 52 on page 29 of the Judgment should read:

“	To conclude, based on the calculations above, I would award a total sum of $454,300 ($295,800+ $48,500 + $110,000) as counterclaimed by the Defendant. I would dismiss the Plaintiff's action for the return of the deposit in the sum of $300,000.”

Paragraph 53 on page 29 of the Judgment should read:

“

I would take the date of the cause of action be the date the maintenance period expired, viz 31 March 2004. As such, I would award interest of the total sum of $454,300 to the Defendant at half of the judgment rate from 31 March 2004 up to the date of judgment, and thereafter at judgment rate until full payment.”
