On the first day of the trial in this matter an issue arose as to whether or not a subpoena, served by the plaintiff, Mr Hill, upon a solicitor, Mr Robertson, should be set aside, on the application of Mr Borrelli and Mr Flynn, on the grounds that the evidence that would be given by Mr Robertson was protected by legal professional privilege.
