判案書

1.原告人的申索,是要求被告人對他作出賠償。他指稱,由於服用了被告人的產品,他的身體出現各種毛病。2003年10月,他的左肩骨一連酸痛10多天;他受到被告人在報紙刊登有關它的產品的廣告所吸引,遂購買了被告人的產品。在6個月期間他連續服用了10瓶該些產品。2004年4月12日,在早晨睡醒時,他發覺左拇指腫脹僵硬,他便前往律敦治醫院求診。由2004年4月至2005年5月,他的左肩骨、左腰骨、右拇指、左踝骨、右肩骨等處遭受游走性關節炎的侵襲。由2004年4月(即停用被告人產品後)至2005年4月期間,他沒有向任何骨科醫生求診。2005年5月,他開始轉向醫生求診。

2.原告人在庭上聲稱,因依賴被告人報章廣告上的內容,以及因服用了被告人的健康產品6個月,而延誤求醫。在2009年6月8日的醫療報告內,方津生醫生指出:“As to the relationship between the drugs he took from October 2003 to April 2004, there is no evidence that the drugs caused any direct injury.  However, the fact that he persisted with the drugs for 6 months instead of seeking treatment for his left shoulder rotator cuff tendinitis led to a delay in diagnosis and proper treatment.  His present condition of shoulder pain and stiffness would have been averted if he had sought earlier treatment.”

3.被告人的報章廣告內容(即原告人證物P1、P2及P3),並沒有將被告人的健康產品寫成可治病的藥物,亦沒有阻止讀者有病求醫或鼓勵讀者有病不去求醫,因此該些廣告內容沒有任何誤導成份。他應該就上述游走關節炎的侵襲,盡早向醫生或醫院求治。他延誤求醫,只是他個人的選擇及決定。

4.2008年8月28日,黃斯愷醫生檢驗被告人。在他的醫學報告(日期為2008年12月3日) ,他有以下的評語:-

“23. Tracing the medical records available (St. Paul’s Hospital), Mr. Lee had multiple joints pain, especially severe over left shoulder and was associated with stiffness. According to Dr. Wu’s report, his problems at 2005 included:

(i) left shoulder rotator cuff tendonitis;

(ii) osteoarthritis of left hip;

(iii) left ankle swelling that was under investigation.

MRI of left shoulder taken showed Bursal-sided partial tear of supraspinatus tendon, tendinopathy of subscapularis tendon and osteoarthritis of left AC joint. I believe the problems included tendinopathy of left shoulder, OA of hip and OA of ACJ were related to degeneration, and should not be related to the usage of health food supplement. It should be presented for long time before the intake of health food supplement. In sum, Mr. Lee’s problems are typical symptoms of chronic degeneration and had no correlation with the health food supplement claimed to be consumed by Mr. Lee. There is nothing to show that Mr. Lee’s problems are caused or aggravated by consuming the health food supplement.

24. Degeneration occurred because of natural wear and tear process. It progress gradually with time and increase frequency of work. Therefore, Mr. Lee is expected to have further increase in frequency and severity of attack in the corresponding area with time. Such problem is common to those doing office or sedentary work and lacking regular physical exercise.

25. For his right thumb condition, there was no record available to prove his right thumb problem. Though he had complained of pain and stiffness after usage of health food supplement. I agree with Dr. L Mahadevan that it may be caused by hypersensitive or part of his general OA problem. In sum, the alleged thumb problem is not shown to be caused by the health food supplement claimed to be consumed by Mr. Lee. There is nothing to show that the alleged thumb problem is caused or aggravated by consuming the health food supplement.

26. On the day of examination, he had:

(i) left shoulder pain that was classified as mild with no attack on daily activities;

(ii) left ankle edema with no pain, especially after prolonged walking;

(iii) left hip weakness, especially during stairs walking;

(iv) no more back pain;

(v) no more right thumb pain.

27.  I believe his left shoulder, left ankle and left hip problems are related to his underlying degenerative changes.

本庭沒有專家証人的証據反駁上述的結論,因此本庭接受上述的評語。

5.本庭沒有証據証明由於他服用被告人的產品而引致身體遭受游走性關節炎襲擊;被告人產品的廣告亦沒有誤導他延誤求醫,因此原告人的申索不能成立。本庭把他的申索撤銷。

訟費

6.本庭頒下臨時訟費命令:原告人須支付被告人本案的訟費(但不包括被告人聘請大律師的費用);如與訟雙方未能訟的款額,訟費款額由議定法庭評估;如在14天内,與訟任何一方不向本庭提出申請,是項命令作實。
