On 23 December 2021, the applicant filed a Notice of Motion out of time to apply for leave to appeal to the Court of Final Appeal against this Court’s (Au JA and L Wong J) judgment of 20 October 2021 (“the Judgment”) ( [2022] HKCA 1535 ). In the Judgment, we dismissed the applicant’s appeal against the decision of Deputy High Court Judge To dated 18 June 2021, refusing his application for leave to apply for judicial review ( [2021] HKCFI 1759 ).
