This appeal concerns a decision of a District Court judge in the course of an application for a permanent stay of criminal proceedings, and the order that followed, namely, to stay the proceedings. After the close of evidence for the defence in the stay application, and after counsel for the defendants had made their submissions, counsel for the prosecution sought leave to call evidence, having originally said that he would not.
