1. At the conclusion of the hearing, we allowed the appellant’s appeal, quashed the conviction and set aside the fine, with reasons to be handed down on a date to be notified. We also ordered that the costs here and before the Court of First Instance be to the appellant, to be taxed if not agreed. The reasons for our decision are now set out in the judgment of Mr Justice Chan PJ.
