1. This is the application on the part of the Defendant for leave to appeal against this court’s decision given on 2 April 2014. On that occasion, this court dismissed the Defendant’s appeal against the Order of Master Ho dated 7 February 2014, whereby it was ordered that the hearing of the Plaintiff’s Originating Summons dated 6 February 2013 be adjourned to a date to be fixed with 2 hours reserved before a Master in chambers, costs reserved.

Although this is the Defendant’s application, he is absent today. 3.In these circumstances, I would accede to the Plaintiff’s suggestion and dismiss the application for leave with costs.
