申請人（原審共有12名被告人（「 D1 」至「 D12 」），申請人為 D10 ）被控一項「以三合會社團成員身分行事」罪（原審控罪8） [1] ，在區域法院法官王詩麗（「 原審法官 」）席前受審，於2025年3月31日被裁定罪名成立，於2025年4月29日被判處監禁6個月。

申請人是原審的D5。他在審訊第四天承認控罪1‘暴動’和控罪2‘有意圖而傷人’ [1] ，在第五天承認相關的案情。原審區域法院暫委法官把他的輕判請求押後，以待其他同案被告的審訊結束。然而，在求請當天，申請人申請推翻兩項控罪的認罪答辯，在經過審理後則被駁回。申請人最終被判入獄共4年6個月。申請人不服，同時就定罪（自行處理）和刑罰（有律師代表）提出上訴許可申請。

On 20 March 2024, this court (Barma JA and Lisa Wong J) handed down a judgment dismissing the applicant’s application for extension of time to appeal against the decision of DHCJ KW Lung dated 20 October 2022 refusing to extend time for the applicant to appeal against his decision dated 21 July 2022 by which he refused to grant leave to the applicant to apply for judicial review. The applicant had sought to review the decision of the Torture Claims Appeal Board/adjudicator of the Non-Refoule

On 15 May 2025, this court (Chu VP and Barma JA) handed down a judgment dismissing the applicant’s application for extension of time to appeal against the decision of DHCJ Bruno Chan dated 11 June 2020 refusing leave for the applicant to apply for judicial review. The applicant had sought to review the decision of the Torture Claims Appeal Board dismissing his appeal against the decision of the Director of Immigration rejecting his non-refoulement claim.
