DECISION ON COSTS

Hon Yuen JA (giving the decision on costs of the Court):

1.On 4 March 2016 this court delivered Judgment allowing the plaintiff’s appeal from the Judgment of Deputy DJ Ludwig Ng.

2.The defendant sought leave to appeal to the Court of Final Appeal.  The matter was dealt with on paper.  In a Decision dated 1 August 2016, this court refused leave and directed that there should be a summary assessment of costs.

3.The defendant then sought leave from the Court of Final Appeal, which was refused by the Appeal Committee on 9 February 2017.

4.The plaintiff has provided a bill for $60,906 in respect of the costs of the application for leave to appeal.  The defendant did not provide any comments on the bill within the time allowed or at all.  Having considered the simplicity of the application, we take the view that a sum of $48,000 would be adequate and we would order the defendant to pay this sum to the plaintiff.
