Common Fund Costs – Costs Assessment – Legal Aid – Barrister Fees – Appeal – Setting Aside Property Disposal – Freezing Order – The appellant appealed against the costs assessment of Common Fund Costs between her and the Legal Aid Department. The appeal concerned two barrister fees: one for an affidavit and one for a court appearance. The receiving party agreed to waive the affidavit fee and part of the court appearance fee. The court held that the barrister fees for the freezing order application were valid despite the later order refusing costs for the setting aside application. The appellant's claim for costs against her former solicitors and Legal Aid was dismissed. Each party bears their own costs of the appeal.
