Hon Poon JA (giving the Judgment of the Court) :

1.By a judgment handed down on 18 February 2016, the Court of Appeal (Barma and Poon JJA) dismissed the applicant’s application for leave to appeal against the orders of Acting Chief District Judge Justin Ko dated 16 November, 2 December and 9 December 2015.  By a notice of motion filed on 3 March 2016, the applicant applied for leave to appeal to the Court of Final Appeal against the Court’s said decision.

2.Under section 14AB of the High Court Ordinance Cap 4, no appeal lies from a decision of the Court of Appeal as to whether or not leave to appeal to it should be granted.  The applicant’s application for leave to appeal to the Court of Final Appeal is therefore entirely misconceived.  It is accordingly dismissed.
