Short write-ups of recent Hong Kong judgments.
On 14 October 2026, the Court of Final Appeal handed down judgment in Wong Chee Sing v Hung Wah (FACV 4/2026), dismissing the appellant's appeal and confirming the Court of Appeal's decision that the respondent had acquired title to a Kowloon shop by adverse possession. Mr Edward Chan SC, Mr Andrew Mak and Ms Jamie Pang, instructed by Deacons, acted for the successful respondent.
On 14 October 2026, the Court of Final Appeal handed down judgment in Ho Kong, The Sole Executor of the Estate of Fong Mi Yee Deceased v Director of Lands [2026] HKCFA 35, dismissing the Director's appeal and confirming that the holder of an absolute possessory title qualifies as an "owner" eligible for the Home Purchase Allowance (HPA) under the Government's resumption compensation policy. Mr Adrian Lai and Mr Han Sheng Lim, instructed by Chak & Associates LLP, acted for the successful respondent.
On 2 October 2026, Deputy District Judge Siu Chiu-kin handed down judgment in _Fung Kung Kuen & 2 Ors v IP Woon Shun, the administrator of the estate of Fung Ching Jess (deceased) & Anor_, DCCJ 4067/2019, [2026] HKDC 1806, finding in favour of the three plaintiffs on their claim to a one-quarter beneficial interest each in Flat D, 33/F, Block 1, Grand Horizon (海欣花園), 11 Cheung Wan Street, Tsing Yi (the "Tsing Yi Property"). The plaintiffs, who acted in person, succeeded against the second defendant (Micky Ren), the widower of the deceased Fung Ching Jess, who also acted in person. The first defendant, the estate administrator, was represented by Ko & Ip and took a neutral stance throughout.
On 25 September 2026, Deputy High Court Judge Wilken KC handed down judgment in Wong Tak Keung Stanley and Another v The Incorporated Owners of Grenville House (HCA 761/2022, [2026] HKCFI 5470), a bitterly contested dispute over water ingress, gas supply and a renovation deposit at the penthouse of Block CD, Grenville House, Mid-Levels. The trial ran from 7 to 16 September 2026 with live transcript and e-bundle. Mr Wong Tak Keung Stanley and Ms Claudia Canepa Wong were represented by Bernard Man SC with Shaun Elijah Tan of Jones Day. The IO was represented by Jonathan Chang SC with Vincent Lung and Calvin Ng of Johnson Stokes & Master.
On 1 September 2026, Deputy High Court Judge Gary CC Lam handed down judgment in HCA 2366/2015, Lee Charles Goon Lok v Lee Kwok Ching and Others, dismissing the Plaintiff's claim and the 3rd Defendant's cross-claim against the 1st and 2nd Defendants, save for an order that the three Brothers, as managers of the Li Wa Fuk Tso, provide accounts of rental income from 11 remaining properties. Mr Jonathan Chang SC leading Mr Timothy Lam acted for the successful 1st, 2nd, 4th and 5th Defendants.
On 31 August 2026, District Judge Harold Leong handed down judgment in three consolidated actions between two brothers, Choi Wai Kwong (plaintiff) and Choi Wai Keung (defendant), finding for the plaintiff across the board. Mr Albert Yau, instructed by Messrs ZM Lawyers, acted for the successful plaintiff; Ms Virginia Y T Leung of Pauline Wong & Co. appeared for the defendant.
The dispute concerns a North Point flat purchased by the late Tan Su Chin in 1983. On 8 April 2004, the Deceased executed a Will and a Deed of Gift on the same day at Messrs S K Wong & Lee. The Deed of Gift assigned the Property to himself and the Defendant, Leong Foong Yin, as joint tenants. The Will bequeathed the Deceased's Hong Kong estate in three equal shares to his three sons from his marriage to Madam Nah. After the Deceased died in 2019, his children from Madam Nah (the Plaintiffs) sought to set aside the Deed of Gift for mistake or non est factum, alleging an "Arrangement" under which D would receive only 50% of the beneficial interest. D counterclaimed for possession, the title deeds, keys, and mesne profits.
