1. The appellant was convicted, after re-trial, [1] of murdering his girlfriend. He was granted leave to appeal that conviction on the ground that it was reasonably arguable the judge presiding over his re-trial misdirected the jury in respect of the objective limb of the defence of provocation as it applied to his case.
