Short write-ups of recent Hong Kong judgments.
On 14 September 2026, the Court of Appeal (Au and Anthony Chan JJA) handed down judgment in Ku Camey v Ku Scarlet (executrix of the estate of Chen Elsie, deceased) CACV 561/2024, dismissing the plaintiff's summons for leave to file a respondent's notice out of time, but granting leave to adduce two post-judgment letters as fresh evidence on appeal. Mr Axis Yu, instructed by Iu, Lai & Li, acted for the successful 1st Defendant.
On 11 September 2026, Deputy District Judge Lam Suet-ying handed down judgment in DCCJ 2731/2021 (Ng King-sang v Leung Pui-ha), allowing the plaintiff's appeal in part against orders made by Master Cheung on 29 January 2026. The plaintiff, a litigant-in-person, had originally sued the owner and occupant of the flat above his (the upper flat at 1201 of Tsui Ping North Estate) for water leakage damage. Ms Yeung of counsel, instructed by Messrs Li Shuk-ping & Co., acted for the successful first defendant.
On 11 September 2026, Deputy High Court Judge Gary CC Lam handed down judgment in Securities and Futures Commission v Lo Kai Bong and Others [2026] HKCFI 5211, continuing worldwide Mareva injunctions against Lo and his wholly-owned Major Success Group Limited. On 1 September 2026, the Court of First Instance (K Yeung JA, sitting as an additional judge) handed down judgment in HCA 1699/2019, Chen Hongqing v. Liu Yiu Keung Stephen & Others, dismissing the Plaintiff's summons for leave to re-amend his Statement of Claim. On 28 August 2026, the Court of Appeal (Chu VP and G Lam JA) handed down its decision in CACV 160/2022, [2026] HKCA 1615, granting the Respondents' application for security for costs in Emagist Entertainment Ltd v Nether Games (Hong Kong) Ltd and Others, though only in the reduced sum of HK$700,000 rather than the HK$2,000,000 sought. Mr Michael Ng, instructed by Messrs So, Lung & Associates, acted for the successful Respondents. Mr Ian Chau, instructed by Messrs Wong, Hui & Co, appeared for the Appellants.
On 26 August 2026, Deputy High Court Judge Patrick Fung SC handed down judgment in HCA 548/2024, dismissing PricewaterhouseCoopers International Limited's ("International") strike-out application against China Evergrande Group (In Liquidation)'s tort claim. On 19 August 2026, the Court of Appeal (Cheung and Au JJA) handed down its decision in CACV 401/2025, Mammy Pancake Company Limited v Carla Day Limited & Ors, allowing the plaintiff's application for security for costs of the defendants' appeal. On 17 August 2026, the Court of Appeal (Au and Anthony Chan JJA) refused Mr Li Hao Tian's application for leave to appeal to the Court of Final Appeal in CACV 480A/2024. On 3 August 2026, Deputy High Court Judge Jason Pow SC handed down judgment in HCA 873/2022, 三河宏祥混凝土有限公司 v Zhang Yongtie, granting the Plaintiff common law enforcement of two PRC money judgments and entering judgment for RMB 22,855,123.54 plus interest at 15.4% p.a.
