1. A fundamental feature of a fair trial is the right to cross-examine witnesses. As Wigmore pointed out in his classic work on Evidence, for centuries, the policy of the common law system of evidence has been to regard the necessity of testing by cross-examination as a vital feature of the law. And he described it as "beyond any doubt the greatest legal engine ever invented for the discovery of truth". See Wigmore Vol V para. 1367 (1974 ed.).
