1. 上訴人起先涉嫌於2011 年6 月26 日違反「超越雙白線或靠近本身一行為實線而另一行為虛線的雙白線」，警員向他發出一張定額罰款通知書，通知他定額罰款為450 元。2011 年7 月13 日，警方根據香港法例第 204 章《定額罰款(刑事訴訟)條例》第3(3) 條，向上訴人發出一張繳付定額罰款通知書（〝該通知書〞）。該通知書是根據上訴人在運輸處的登記地址郵寄給上訴人。
